PET DOG SALE/ADOPTION CONTRACT
General: The following agreement is between Walt & Sharyn Hutchens, hereafter referred to as Kennel and _________________________, hereafter referred to as Purchaser, for the sale and purchase of one purebred dog of the Whippet breed as follows:

In consideration of the price of ____________. The Kennel transfers in fee simple all rights, privileges, and responsibilities associated with the ownership of the dog to Purchaser subject to the conditions set forth below as of the date specified. The represents the entire agreement between Kennel and Purchaser in an outright sale.

Use of the Dog: It is agreed between Kennel and Purchaser that this dog is being acquired as a family companion and to be used for tasks appropriate to its breed, such as lure coursing, hobby racing, therapy dog, or for exhibition in obedience or agility competition as Purchaser may desire. We agree that this dog is not purchased for resale not will it be used or trained for activities which are illegal or for which it is not suited by reason of temperament or structure. Specifically it will not be used as a guard or attack dog or to fight other animals or in training other animals for these purposes or in commercial dog racing activities.

Performance Rebates: Kennel will pay the following rebates on receipt of proof that the dog has successfully completed the following:
Puppy Kindergarten $25
Agility titles $25
Canine Good Citizen Tests $25
Therapy dog certification $25
Coursing or racing titles $25
Obedience course $25 each
AKC or UKC Obedience title $50
Agility or flyball course $25 each
AKC Conformation Championship (show prospects only) $100

Health: The Kennel warrants the dog to be in good health and free from parasites (fleas, ticks, worms, etc.) as of the time of sale. The health record of the dog is included in the sale. Kennel strongly encourages Purchaser to have the dog seen by a Veterinarian of Purchaser's choice within 72 hours of picking up the dog and to follow said veterinarian's directions for the future care of the dog. If at any time during the life of the dog it develops health problems which in the opinion of two licensed veterinarians are likely to be of an inherited nature, which are unexpected in a dog of that age, and which will interfere with the dog's function as a pet, Purchaser agrees to contact Kennel. Purchaser may return the dog or keep the dog and Kennel will rebate 50% of purchase price.

Right of Return: Said dog may be returned to Kennel for any reason at any time following purchase. If returned within one month from purchase and provided that the dog has not been injured or damaged in any way, the Purchaser will then be entitled to a refund of the original purchase price. Refund amount will be reduced by 10% of purchase price for each additional month or fraction that dog is kept. If on return to Kennel the dog requires veterinary care or incurs other expenses due to negligence on the part of the Purchaser, Kennel's expenses will be deducted from the refund amount. However, regardless of the provisions above, if the dog is voluntarily returned to Kennel at any time, at any age and in any condition, Purchaser is entitled to a refund of 20 percent of the purchase price.

Right of Recovery/Placement: In the event that the Purchaser is unable to keep the dog or provide an appropriate home in accordance with this agreement, Purchaser agree to contact Kennel. Purchasers may return the dog to Kennel, or with the Kennel's concurrence, place the dog in a home of their choosing which is approved by the Kennel. Purchasers will not abandon the dog, surrender it to a shelter, or without the Kennel's permission, sell or give the dog away. If dog is found to have been sold or given away with the Kennel's permission, Kennel may take legal action to recover same and original Purchaser of the dog will be responsible for all expenses incurred.

Registration: The Kennel certifies that the dog is registered with the American Kennel Club and/or the United Kennel Club as a purebred whippet and will provide forms for transfer of such registration. Kennel further certifies that the animals named in the registration are the actual parents of the purchased dog.

Ownership responsibilities: The Purchaser agrees to maintain the dog as a house dog in a humane environment and properly socialize, train, and care for it. The dog will be properly licensed, will be kept substantially free from parasites, and will be maintained on heartworm preventative medication and inoculated against rabies, distemper, parvovirus and other communicable diseases as recommended by a qualified veterinarian. Purchaser understands that as a matter of breed characteristics, whippets are likely to kill small animals such as cats and accepts all responsibility for any such event. Purchaser also understands that whippets are likely to run away and must at all times be confined to a fenced area or restrained by a leash. The dog will not be allowed to roam at large.

Spay/Neuter: As this dog is being sold as a pet, not a breeding animal, the Purchaser agrees not to breed the dog and to have the dog spayed or neutered before the dog is over a year old. Health benefits of spaying are greatly increased if the surgery is performed before the dog's first estrus, generally occurring between six months and 12 months of age, but Purchaser should follow the recommendations of a veterinarian. Kennel will refund to the purchaser $100 upon proof of spay or neuter.

Limit of refunds and rebates: In no case will the total amount returned to the Purchaser exceed the amount paid by the Purchaser to the Kennel.

Jurisdiction: Buyer agrees that this contract will be bound by the laws of the State of Virginia and that any dispute regarding this contract will be settled in a Virginia State court in the county of Rockbridge.
